Amanda Collura-Day defends the rights of clients faced with complex toxic tort and mass tort actions, general business and commercial litigation, and appellate advocacy at the highest levels of practice. Among her clients are Fortune 500 companies, privately held businesses, and individuals involved in industry sectors ranging from petrochemical and engineering to technology, pharmaceutical, and gambling/entertainment.

From venue analysis through litigation, at trial, and on appeal, Amanda is that advocate who knows how to apply and leverage the law and the Louisiana court system to her client’s advantage. Amanda has set and stays fully briefed on evolving legal precedents that could impact her clients and their respective markets. She brings proven skill to resolving major class action litigation involving chemical exposures and catastrophic accidents.

On attack or defense and before state and federal court and involving single and multi-plaintiff claims, class actions, and multidistrict litigations, Amanda is among the most efficient and exacting legal strategists, case managers, and brief writers at the firm. She is valued for her ability to quickly analyze the many moving parts of major claims in real-time and for designing and executing litigation strategy in and out of court – ably guiding clients through the many decisions associated with filing, litigating, trying, and appealing high-stakes claims. Notably, she is skilled in articulating how complex legal theory is applied to her client’s case, as well as when an exception can be made.

Her experience includes appellate consultation from the inception of litigation, through pre-trial, trial, and post-trial motion practice and an informed assessment of the likely chances for success on appeal. She is skilled in ensuring appellate arguments are preserved throughout the litigation process and at trial and fluent in the procedural and judicial aspects of what it takes to succeed before the Louisiana Court of Appeals and specific appellate judges across the First and Second Circuits. Amanda understands that there are many issues that can be argued on appeal, however, she believes in leading with only those arguments that will impact and persuade the court in her client’s favor.

Representative Experience
  • Representation of an entertainment industry company in a Writ Application filed with the Second Circuit after the Trial Court improperly denied its Motion for Summary Judgment on the issue of whether a business owner/merchant owes a duty to someone for the negligent and/or intentional acts of a third party, that cause harm; the Second Circuit granted the Writ and is requesting briefing on the issue of whether, and to what extent, La. R.S. 9:2800.1 is applicable to this case
  • Representation of entertainment industry company in a final appeal on the issue of whether there was sufficient evidence to support the jury’s determination that the company was liable for the negligent hiring of an independent contractor and the excessiveness of the jury award. At the United States Fifth Circuit the jury’s liability determination was affirmed but the Court reversed the jury award. The Court found the million-dollar jury award was excessive for future pain and suffering for ankle injuries suffered by a 33-year-old pedestrian with life expectancy of 52.2 years who was struck by manlift, even adjusted for inflation and with 50 percent enhancement provided for under Louisiana law, and thus the trial court abused its discretion in denying casino operator’s motion for new trial or remittitur on negligence claims. The jury award was vacated and remanded to the Trial Court for a new trial on damages or a remittitur determination. Echeverry v. Jazz Casino Co., L.L.C., 988 F.3d 221, 229 (5th Cir. 2021). Advised on the LMOGA Amicus Brief that supported a refining company in its appeal against a judgment granting damages to a plaintiff for negligent infliction of emotional distress and resulted in a reversal of the Trial Court’s award of damages for NIED in this matter due to the lack of evidence
  • Assisted trial counsel in defending high-profile, multiple-plaintiff lawsuits arising out of an explosion and fire at a major Louisiana chemical manufacturing facility where our emergency response and trial teams advised on the official notification, evidence preservation, incident investigation, interaction with state and federal regulatory authorities, litigation management, and complex mass joinder and personal injury trial defense in multiple venues, including taking several cases to verdict
  • Assisted in the representation of a major olefins production facility on significant legal issues in the appellate courts and the Louisiana Supreme Court
  • Representation of a casino in a personal injury suit alleging liability for third-party criminal conduct
  • Representation of municipalities throughout South Louisiana in the defense of federal civil rights suits
  • Representation of a municipality against multiple claims of wrongful termination, First Amendment, and retaliation violations
  • Representation of a municipal planning commission in a multi-million-dollar land-use dispute with a real estate developer.
