Veteran trial lawyer and appellate advocate, Linda Broocks, resolves serious commercial and personal injury claims, complex securities disputes, toxic tort and premises liability claims, real estate controversies, and employment-related lawsuits. She also advises on securities regulatory issues and represents clients before myriad administrative bodies, such as the Financial Industry Regulatory Authority.

Linda remains grounded in substance and fact allowing her to mitigate contention and clear a viable path to resolution – be it through carefully curated negotiation, via ADR, at trial, and/or on appeal. Fact-based, understated, and dedicated to the highest ethical standards, Linda believes in continuously earning her credibility and steadfast reputation for serving as a formidable, effective, and adaptable advocate at the pinnacle of her career. This is among the many reasons her clients, ranging from Fortune 500 corporations to individuals, return again and again to resolve their most difficult and big-ticket disputes.

Whether serving as lead or local counsel, Linda takes pride in her work and is personally satisfied when she navigates clients through and beyond the stress and acrimony associated with problematic single-plaintiff, multi-plaintiff, and multi-state claims, class actions, and MDLs. Having earned her Texas Board of Legal Specialization certifications in Civil Trial Law and Civil Appellate Law, Linda is also a member of the American Board of Trial Advocates.

Linda has been a certified mediator since 2005 and has additionally been certified as a family law mediator. She is also an arbitrator for FINRA.

In addition to the law, Linda ran a clothing business and worked as an administrator at MD Anderson Hospital coordinating the volunteer program. She also served as a Judicial Law Clerk to the Honorable Judge John R. Brown, Chief Judge of the United States Court of Appeals for the Fifth Circuit from 1978 to 1979. It was at the very beginning of her legal career that she gained an internal perspective as to how the courts operate and what judges value when hearing cases. She brings this valuable perspective to every case in which she is involved today.

Representative Experience
  • Obtained a reversal on the appeal of a dismissal of shareholder derivative claims against aider/abettor defendants.
  • Successful defense of a national investment banking firm in a suit alleging securities fraud in connection with a public stock offering.
  • Ongoing representation of a variety of firms and individuals in connection with investigations conducted, and suits brought, by the SEC, FINRA, the CFTC, the NFA, and various state regulatory authorities.
  • Ongoing defense of claims of product liability and gross negligence in suits involving gas explosions and toxic exposure.
  • Ongoing representation of registered representatives of securities broker dealers in securing CRD record expungements and in transitioning between firms.
  • Secured a favorable settlement in a copyright infringement suit for a songwriter against a world-famous star.
  • Successful defense of multiple claims before the EEOC.
  • Defense award in an arbitration alleging fraud on the market in connection with mortgage-backed securities investments.
  • Successful prosecution of fraud and contract claims arising out of a corporate merger.
  • Successful prosecution of claims arising out of fraudulently marketed unregistered securities.
  • Defeated certification of various purported state and national class actions.
  • Successfully defended a national brokerage firm in a series of cases alleging fraudulent research.
  • Co-counsel for plaintiffs in mass action lawsuits resulting in millions of dollars in settlements for limited partners in partnerships formed by major U.S. hotel chain.
  • Successfully defended an oil field services company accused of fraud and breach of contract by the operator of a gas well and prevailed on a counterclaim, including successfully defending the appeal to the Texas Supreme Court.
  • Obtained and collected a significant award for several foreign investors against an international multi-level marketing company, including a successful appeal that reversed a vacatur of the award.
  • Led the defense team in the representation of a major brokerage firm against claims by hundreds of plaintiffs arising out of failed commercial real estate loans.
  • Has secured reversal on appeal of multiple large jury verdicts.
