Michael Lowe is an experienced and proven business counselor, advocate, and litigator who is skilled in resolving complex business disputes and advising on legal issues involving construction, labor and employment, and commercial matters. Listed among Louisiana Super Lawyers and The Best Lawyers in America, Michael earned his reputation for consistently smart instincts, client resource conservation, and achieving favorable results when serving as outside legal counsel to companies doing business in Louisiana.
Michael is a problem solver who is dedicated to safeguarding the rights of businesses. He is a practical, effective, and persuasive commercial law advocate – in and out of the courtroom – with the multi-jurisdictional state and federal court experience needed to guide companies through all stages of dispute avoidance and dispute resolution.
Michael’s experience is uniquely multi-faceted. His practice ranges from the resolution of complex litigation to providing real-time advice on a myriad of construction and employment disputes. He devotes substantial time and effort to assisting municipalities and government agencies with disputes involving Louisiana’s civil service laws and regulations.
Michael also represents employers in connection with investigations conducted by federal and state agencies, including the U.S. Equal Employment Opportunity Commission, U.S. Department of Labor, U.S. Occupational Safety and Health Administration, the Louisiana Commission on Human Rights, and the Louisiana State Licensing Board for Contractors.
Michael helps employers navigator through the legalities of HR policies and procedures, drafts and enforces employment arrangements, including non-competition, confidentiality, and non-solicitation agreements, and advises on the hiring, counseling, discipline, and termination of employees. He has particular experience in aggressively defending and enforcing non-compete agreements and other restrictive covenants. Michael also helps to resolve Americans with Disabilities Act access cases, otherwise known as “drive-by” or “Google” lawsuits.
Michael’s construction experience involves all aspects of litigation and trial practice. He defends the rights of general contractors and project owners involved in disputes ranging from engineer/architect claims to administrative protests under the public procurement and public bid laws. He drafts and reviews all types of construction contracts, including original documents and industry forms, and advises on Louisiana’s lien laws, including both the Louisiana Public and Private Works Acts. Michael is adept in leveraging the benefits of alternative dispute resolution, such as arbitration and mediation, to minimize project delay and legal expenses.
Michael frequently acts as outside general counsel to his clients, where he serves as a trusted strategic advisor to businesses across the state. He believes in sound judgment, meticulous case and risk analysis, straightforward communication that is clear and easily understood, and legal solutions that resolve even the most difficult challenges.
