Josiah Kollmeyer practices with the energy and environmental litigation group. He works on major cases involving oil field legacy disputes, coastal wetlands, and commercial litigation matters. He is relied upon to keep cases moving forward toward resolution and is involved in all phases of case development, ranging from pre-certification motion practice and discovery to class certification motions, expert discovery, hearings, and trial.
Josiah brings particular skill to drafting pleadings and organizing experts and other defense materials in a manner that is streamlined and more comprehensible for his clients. His oral and written communication acumen is manifest in his ability to articulate difficult issues and facts in a manner that is easily understood by laymen, industry experts, and judges and juries alike. He believes, given his prior experience working for the DOJ and various judges, in the importance of arguments that are clear, concise, and conserve the judge’s time.
Josiah is also dedicated to finding the right information across all types of discovery that can potentially eliminate a lawsuit at the earliest stages of litigation. He applies the requisite creativity and aptitude for supporting productive negotiation and favorable compromise when it is needed most. Josiah brings the talent needed to prepare the case for trial if needed and the practical know-how to effectively fight for his client’s rights. He is committed to establishing relationships of trust not only with clients and colleagues, but also with the judges, juries, arbitrators, and mediators who ultimately hold the fate of the matter in their hands.
Josiah worked as a Law Clerk to the Honorable Kyle Duncan of the U.S. Court of Appeals for the Fifth Circuit and the Honorable Mark Martin of the Supreme Court of North Carolina. He also served as Assistant Solicitor General for the Louisiana Department of Justice.
These experiences allowed Josiah to witness effective and ineffective lawyering in action from a judge’s perspective. Today, he consciously applies this hands-on skill to creating persuasive arguments that align with what judges look for and value. He also honed his ability to draft compelling and streamlined briefs, motions, and pleadings.
Notably, while at the DOJ, Josiah successfully argued an appeal before the Louisiana Supreme Court involving a constitutional challenge. Moreover, Josiah’s tenure with the courts and DOJ taught him how to deal with heated and highly controversial issues in a calm and lawyerly way, by applying arguments in an analytical and logical manner.
- Served as lead associate on two legacy cases with successfully settlements.
- Worked extensively on discovery matters for the Delta Utilities/Entergy natural gas regulatory approval project, which received unanimous approval from both the State Public Service Commission and the New Orleans City Council.
