This presentation will discuss managing employee leave requests, a common issue for many companies. We will cover mandatory leave under the FMLA, ADA-related leave requests (including intermittent, indefinite, and remote work requests), the impact of workers’ compensation claims, and relevant Louisiana and Texas state laws.
3:00 – 4:00 PM Plant Owners & Personal Injury Defenses: Diving in to Explore the Depths of Statutory Employer Immunity (1 hour)
One of the most valuable defenses available to a Texas or Louisiana plant owner in a personal injury dispute is statutory employer protection. Focusing on Texas and Louisiana law alike, this presentation will: (1) provide an overview of the legal principles and key case law shaping these defenses; (2) examine recent judicial trends on these issues; and (3) offer a checklist that assists in the collection of supporting evidence and forewarns against potential evidentiary challenges. Additionally, this presentation will discuss why a strong understanding of these defenses is more crucial than ever in light of the rise in nuclear verdicts.
