Megan Rapp focuses her practice on business litigation and has managed state and federal litigation from the filing of the lawsuit through appeal. Megan handles a variety of litigation matters for businesses and individuals on both the plaintiff and defense side. She routinely represents clients in litigation involving claims for fraud, breach of contract, breach of fiduciary duty, and tortious interference. Megan has also represented clients in negligence cases related to property damage and personal injury, employment disputes arising out of state and federal law, and cases involving construction defects and lien disputes. Megan also routinely handles appeals, and she has been involved in nearly 40 civil appeals in Texas state courts.
- Obtained multi-million dollar judgment, including punitive damages, for company after it was discovered that previous CFO had misappropriated a significant amount of money.
- Obtained summary judgment in arbitration on behalf of client in a case brought against a company by former executive for breach of contract.
- Obtained highly favorable settlement for client after trial court granted pre-trial motion holding that plaintiff was not entitled to the majority of its requested damages as a matter of law.
- Obtained a pre-trial walk away for a business and its executive in a billion-dollar trade secret and breach of fiduciary duty case in Harris County, Texas.
- Defeated a TCPA Motion in a dispute involving property ownership.
- Won an appeal where the trial court erroneously granted a TCPA Motion in a dispute between a homeowner and the HOA.
- Obtained summary judgment in favor of employer in an FLSA case.
- Obtained death penalty sanctions and default judgment on client's counterclaims after a year-long discovery dispute.
- First chaired arbitration in a business divorce and breach of fiduciary duty case involving a closely held limited liability company.
- First chaired bench trial in breach of contract and DTPA case arising out of the construction of residential property.
- First chaired bench trial in fraudulent inducement case against a prominent Houston real estate investor.
- Negotiated highly favorable settlement after forcing opposing party's company into receivership.
- Obtained case-ending death penalty sanctions against a plaintiff in a construction case after a year-long discovery dispute.
- Obtained summary judgment for employer in FLSA lawsuit.
- Successfully defended against numerous summary judgment motions and obtained favorable settlement for property owner injured as a result of flooding caused by nearby construction.
