Veteran legal advocate and trusted adviser, Bob MacIntyre, resolves all types of estate, trust, and guardianship matters. He defends the rights of individuals, families, institutions, trust companies, creditors, and non-profit and charitable entities faced with complex estate-related disputes inside and outside of court. Bob’s deep bench of expertise in trust and estate law and litigation; proven negotiation, conflict resolution, litigation, and trial acumen; and longevity of practice, objectivity, and perspective make him a go-to problem-solver across Texas and beyond.
At the pinnacle of his career, Bob defends the rights of fiduciaries and beneficiaries in every aspect of estate and trust-related litigation. In and out of court and at trial, Bob maintains a successful track record of impressive outcomes involving will and trust contests, ownership, creditor, and estate/gift tax disputes, breach of fiduciary duty, and fee controversies. He effectively resolves a wide variety of other estate and fiduciary-related disputes, including lawsuits involving the allocation of estate and generation-skipping transfer tax liability among beneficiaries, sub-trust funding, the propriety of selling assets, and disputes surrounding capacity, undue influence, and fraud.
Bob has successfully advocated client positions in courts across Texas, including state district, probate, and appellate courts. Although Bob earned his stellar reputation over many decades of practice as a premier litigator and trial advocate, he believes in negotiating favorable settlements that conserve client time and resources and mitigate family acrimony. He brings proven skill to guiding fiduciaries and beneficiaries through behind-the-scenes, discrete negotiations that address the serious conflict inherent in emotionally charged disputes, difficult personalities, and challenging family dynamics. He also brings a proven track record of efficient results through the use of alternative dispute resolution before turning to the courts.
Bob’s wealth of experience, undeniable expertise, practice longevity, and bigger-picture perspective when resolving client disputes and litigation in a manner that is not only aggressive but also efficient and effective is second to none in the industry today. He knows the risks inherent in embarking on a full-court battle and believes that litigation is only one option for solving private wealth and estate controversy. Today, Bob is valued for being both strategic and creative when dealing with particularly difficult estate controversies and related financial issues.
Prior to private practice, Bob served as an Assistant Attorney General of the State of Texas. He took great pride in public service and in proudly stating, “The people of Texas are ready.” Earlier in his career, Bob also worked on a wide variety of commercial litigation and personal injury matters, where he learned to design reasonable and fact-based positions and highly persuasive arguments, including the art of procedural evidentiary tactical maneuvering – critical skills that draw upon his creativity and intellectual prowess today. Bob also handled a variety of contentious divorces in and out of court, where he acquired critical skills in effectively addressing and overcoming unique personal and family dynamics when separating emotion from fact.
