Scott Seidl focuses his practice on probate, trust, and guardianship litigation matters. He also has real estate and energy experience. Scott primarily handles litigation but has experience in transactional matters in all these areas. He has represented clients in both state and federal courts for more than a decade.

REPRESENTATIVE EXPERIENCE

Probate Litigation

  • Represented common-law spouse in the administration of husband’s estate to recover a share of assets.
  • Represented beneficiaries in will contests and actions to void transfer on death deeds.
  • Defended surviving spouse against claims from other spouse’s purported children.
  • Prosecuted and defended fiduciaries in breach of fiduciary duty claims.
  • Represented trustees and beneficiaries in modifications of trust agreements.
  • Represented applicants and contestants in contested guardianship proceedings.

Real Estate Litigation

  • Represented homeowners and vendors in title disputes, breach of warranty claims, fraud claims and boundary line disputes.
  • Represented commercial real estate brokers in actions to recover unpaid broker’s commissions.
  • Represented landlords and tenants in disputes regarding the interpretation of leases, unpaid rent, and maintenance charges.

Real Estate Transactions

  • Researched, prepared, and obtained title curative for highly complex surface and mineral title.
  • Drafted purchase agreements, lease agreements, amendments, easements, and other agreements involving real property.
  • Represented landlords, tenants, developers, buyers, sellers, contractors and materialmen, and lenders in all manner of business, finance, and ownership transactions, including removal of expired liens, preparation of liens, preparation of deeds, leases, notes, deeds of trust, UCC filings, surface use waivers, easements, stipulations, and personal guarantees.

Oil, Gas, and Energy

  • Defended a family-owned oil and gas company against a multi-million-dollar indemnity demand stemming from a prior operator’s environmental contamination.
  • Represented the purchaser of an offshore production platform in a dispute with the seller.
  • Represented independent oil and gas companies in title and royalty disputes.
  • Negotiated and drafted purchase and sales agreements, asset purchase agreements, joint operating agreements, and assignments in connection with oil and gas acquisitions and divestitures.
  • Negotiated surface use agreements, easements, and other contracts as well as provided review and analysis of existing agreements.
  • Litigated oil and gas disputes, condemnation, environmental contamination, and general commercial litigation matters.
  • Drafted surface and mineral title opinions covering lands in Texas, Oklahoma, and North Dakota.
